Article 1 – Definitions
Matcare DE: Lenx, established in Bedum, registered with the Chamber of Commerce under number 72665890.
Customer: the natural or legal person who enters into an agreement with Matcare DE.
Agreement: the agreement between Matcare DE and the Customer regarding the purchase of products.
Cooling-off period: the period within which the Customer may exercise the right of withdrawal.
Right of withdrawal: the right of the Customer to cancel the agreement within the cooling-off period.
Article 2 – Applicability
These Terms and Conditions apply to every offer by Matcare DE and to every agreement concluded between Matcare DE and the Customer.
By placing an order, the Customer accepts these Terms and Conditions.
Matcare DE reserves the right to amend these terms. The most current version is always available on the website.
Article 3 – Offers and prices
All offers are without obligation and valid while stocks last.
Prices are in euros and include VAT, unless stated otherwise.
Shipping costs are not included in the product price and are shown separately at checkout.
Obvious errors or mistakes in offers are not binding on Matcare DE.
Article 4 – Orders and agreement
The agreement is concluded at the moment the Customer has completed the order process and Matcare DE has confirmed the order by email.
Matcare DE reserves the right to refuse orders or to impose additional conditions.
Article 5 – Payment
The Customer can pay via iDEAL, PayPal, credit card or Bancontact.
Payment is made in advance. The order will only be processed after payment has been received.
In the event of late payment, the Customer is in default by operation of law.
Article 6 – Shipping and delivery
Matcare DE aims to ship orders placed and paid for on business days before 21:30 on the same day.
Delivery times are indicative and not strict deadlines. Exceeding the delivery time does not entitle the Customer to compensation.
The risk of damage or loss passes to the Customer at the time of delivery.
Article 7 – Right of withdrawal
The Customer has the right to cancel the agreement within 14 days of receiving the product without giving any reason (cooling-off period).
To exercise the right of withdrawal, the Customer must inform Matcare DE by email ().
The Customer must return the product within 14 days of notifying the withdrawal.
The product must be returned unused, undamaged and in its original packaging.
The costs of return shipping are at the Customer's expense.
Matcare DE will refund the purchase amount within 14 days of receiving the returned product, via the same payment method used for the original purchase.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to products that are sealed for hygienic reasons and whose seal has been broken (such as pregnancy tests, ovulation tests, menstrual cups and vaginal tests), and products that have been irreversibly mixed with other products after delivery.
Article 8 – Warranty and conformity
Matcare DE guarantees that the products conform to the agreement and meet reasonable standards of durability and usability.
The statutory warranty applies: products must be what the Customer could reasonably expect.
Complaints about defects must be reported to Matcare DE within a reasonable time after discovery.
Article 9 – Complaints
Complaints can be submitted via .
Matcare DE aims to handle complaints within 14 days.
If the Customer and Matcare DE cannot reach a resolution, the Customer may use the European ODR platform: https://ec.europa.eu/odr.
Article 10 – Liability
The liability of Matcare DE is limited to the amount paid out by the insurer, or alternatively to the invoice amount of the relevant order.
Matcare DE is not liable for indirect damages, consequential damages or lost profits.
The limitations of liability do not apply if the damage is attributable to intent or gross negligence on the part of Matcare DE.
Article 11 – Personal data
Matcare DE processes personal data in accordance with the General Data Protection Regulation (GDPR).

Article 12 – Applicable law and disputes
All agreements are governed by Dutch law.
Disputes shall be submitted to the competent court in the district of Noord-Nederland.
Article 13 – Miscellaneous
If any provision of these Terms and Conditions is found to be void or voidable, the remaining provisions shall remain in force.
In cases not covered by these Terms and Conditions, Matcare DE shall decide.
